General terms and conditions of business

§ 1 Scope, customer information
These General Terms and Conditions (GTC) govern the contractual relationship between Mark El-Mohamed / sole proprietorship, www.sapeur-osb-shop.de, and consumers and businesses who purchase goods through our online shop. Deviating terms and conditions are not recognized unless we have expressly agreed to them in writing. The contractual language is German.

§ 2 Conclusion of contract
(1) The product presentations in the online shop do not constitute a legally binding offer, but a non-binding invitation to order.
(2) By clicking the order button, you place a binding order for the goods contained in your shopping cart. Confirmation of receipt of your order will be sent by email immediately after you submit your order.
(3) A binding contract is concluded upon receipt of our order confirmation or upon delivery of the goods.

§ 3 Storage of the contract text
We save the contract text and send you the order details and our terms and conditions by email. You can view past orders in your customer account.

§ 4 Right of withdrawal for consumers
(1) Consumers have a statutory right of withdrawal. The complete cancellation policy can be found here: Cancellation Policy .
(2) The right of withdrawal does not apply to personalized or sealed goods which, for health or hygiene reasons, are not suitable for return once the seal has been removed.

§ 5 Prices and shipping costs
(1) All prices quoted include statutory VAT.
(2) Shipping costs will be charged additionally and shown separately during the ordering process.

§ 6 Delivery
(1) Delivery will be made to the address you provide.
(2) The delivery time will be specified during the ordering process. If a product is not available, we will inform you immediately.

§ 7 Payment
Available payment methods are displayed during the ordering process. Delivery on account is only possible upon individual agreement.

§ 8 Retention of title
The goods remain our property until full payment has been made.

§ 9 Warranty and Liability
(1) The statutory warranty rights apply.
(2) For consumers, the limitation period for claims for defects in new goods shall be two years from delivery of the goods.
(3) For entrepreneurs, the warranty period shall be one year from the transfer of risk.
(4) We are liable without limitation for damages resulting from injury to life, body, or health, as well as for gross negligence or intent. In the case of slightly negligent breaches of essential contractual obligations, liability is limited to foreseeable damage.

§ 11 Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr . We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Severability Clause
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
